With 25 years’ experience of having lived and worked in London, the US (Washington DC), and the Middle East (Qatar), as well as most European countries, Gavin has a formidable international background in his areas of expertise of commercial, financial services, banking regulatory and technology. Gavin was trained and has practised Intellectual Property and Information Technology (IP/IT) in two recognised ‘Legal 500 Tier 1 firms’ (Osborne Clarke and Eversheds) from which he expanded and developed his knowledge and expertise of IP/IT across multiple jurisdictions, and he was fortunate to have been mentored by two of the most significant legal technology experts who are well known amongst the legal community for the last three decades.

In addition, Gavin has 17 years’ experience of financial services, having worked for many of the leading financial institutions from 2004 where he developed a solid understanding of banking regulations and operations. As well as reporting to C level on the impact of FCA regulations and advising on operational measures to mitigate corporate risk, Gavin was responsible for negotiating all high risk, high complex agreements for the various banks to ensure their corporate exposure was mitigated. Gavin has advised numerous well known investment banks on regulation, from advising on the applicable regulation of Brexit with the Lloyds Banking Group and the subsequent restructure by negotiating their Intra-Group Agreements, to heading up the legal function of the Financial Crime Compliance Program for HSBC to ensure regulatory compliance with the requirements of the SEC, and negotiating all complex high value, high risk software technology, AI, big data and algorithmic consultancy programs were delivered on time, at cost and in compliance with the regulations. Gavin was also engaged by Credit Suisse to negotiate their high value, high risk Terms of Business, and he has recently completed a number of compliance reports for the financial arm of two well-known Japanese motor manufacturers based on the requirements of the FCA and CONC consumer credit regulations.

As an overview, Gavin has advised on Consumer Credit Regulations 2010, Consumer Credit Act 1974/2006, Consumer Credit (Total Charge for Credit), Early Settlement Regulations 2004, SMCR, EMIR, MiFIDII, PSD2, BAIT, Financial Crime Compliance, CDD, KYC, AML, Anti Bribery, GDPR, OECD, FATCA, CRS, European Banking Authorities Outsourcing Regulations, PRA, SYSC8 (Outsourcing), EMIR, Basel III, CRDIV (CDR 2013/575) and (Pillar 1 & 2), REMIT, MAD, BAIT, CDR 2017/565 and 1943, PRIFID, MLD4 (Directive 2014/65/EU), and the Financial Services Banking (Reform) Act 2013, German Banking Act, MAR Risk and BA Fin.

Whilst undertaking technical financial services work, Gavin has also heavily advised on technology and software covering both the negotiation and drafting of new proposition agreements as well as advising on the regulatory work at the forefront of technology implementation with companies such as Vodafone, BT and Finastra overseeing and delivering on current market technology and software projects (such as SaaS, PaaS, AI, mobile SIM/voice and data, payment platforms) and all applicable FCA, GDPR and telecom regulations, including new local porting regulations, and mobile switching regulations.
