Late Payment Compensation:
Suppliers to businesses can include a claim for Late Payment Compensation under the Late Payment of Commercial Debt Regulations 2002, subject to any exclusions under the terms and conditions of trade:

This compensation will be included in the LBA and any legal proceedings, if recovered it will be charged as part of our charges plus VAT. There is also the ability to recover further costs under Clause 2A of the Late Payment of Commercial Debts (Interest) Act 1998 and Regulation 2011/7/EU.
Interest:
Interest can be claimed at either the contractual rate set out in the terms and conditions agreed between the parties or under Statute which is currently 8% or Late Payment Interest of 8% above bank base rate.
International Collection Agents:
Our agents charge a commission basis depending on the jurisdiction and age of the outstanding invoices. This can be between 20-35% and we will obtain a quotation on each matter in advance. The collection agents’ charges will be payable by clients if a successful resolution is reached.
Enquiry Agents/Status Reports/Employment Search/Process Servers:
Our enquiry agents charge £35-40 plus VAT to trace a customer/defendant on a no success no fee basis. The cost of a status report depends on the information required and a quotation can be obtained on a case-by-case basis.
An employment search costs £15.00 plus VAT on a no success no fee basis. Process Servers cost £90.00 plus VAT. The enquiry/status/employment agents/Process Servers charges will be payable by clients as incurred.
Additional Charges:
The team charge £20.00 plus VAT per 6-minute unit for additional work carried out on matters. These will include negotiation and monitoring payment plans, receiving and making telephone calls and emails and providing general advice on matters in the pre-legal stages.

Commercial Litigation:
Once a Defence is filed the matter will be allocated to one of our lawyers within the team. After an initial assessment a cost estimate will be provided, and a strategy discussed to bring the matter to an early conclusion or progress to Trial. A Part 36 offer will be considered to add pressure to the Defendant and if the Part 36 offer is exceeded at Trial/Hearing then this will add additional costs, interest and compensation to the Judgment awarded. Wherever possible we will seek to agree a fixed fee to progress the matter to its conclusion.

We seek to recover the costs from the Respondent and will utilise our hourly rate to ensure that full costs are recovered wherever possible. The costs may be more than our fixed fees listed above and if recovered we will account to you accordingly. If a dispute arises then the lawyer’s hourly rate plus VAT will apply. Additional Counsels fees may be required if hearings are adjourned together with additional costs. Insolvency actions should only be commenced when the claim is undisputed. Courts can award costs against Petitioning Creditors for abuse of process.
